Terms of Use
These Terms govern access to the KashDay website and, once launched, the KashDay mobile application.
Article 1 — Purpose
These General Terms and Conditions of Use (the “Terms”) provide the legal framework for the services offered by KashDay and define the rights and obligations of the parties:
- the publisher of the KashDay service, RISUP, a simplified joint-stock company (SASU) with a share capital of €1,000, registered with the Paris Trade and Companies Register under number 984 046 896, whose registered office is located at 26 rue Bosquet, 75007 Paris, France (the “Publisher”); and
- any natural person acting in a personal capacity who wishes to use the KashDay website and/or application (the “User”).
Use of KashDay requires the User’s full acceptance of these Terms, which may be amended at any time. Upon registration and for each material change, the Terms are submitted to the User for acceptance.
Article 2 — Definitions
- Application — the KashDay mobile application available on the App Store and Google Play Store.
- Website — the KashDay marketing site, including the waitlist and information about the service.
- Kash — a virtual unit of account, non-transferable and non-assignable, credited to the User’s account in return for participation in the Services, convertible under Article 7.
- Question / Quiz — questionnaires distributed via the Application (daily question, profile, habits, preferences, etc.), in compliance with the GDPR.
- Data — personal data within the meaning of Article 4 GDPR, collected at registration and while using the Services.
- Monetisation — commercial use of Data by the Publisher, directly or via third parties, including prospecting, analytics or marketing profiling, in line with applicable law and collected consents.
- Services — all features of the Website and the Application.
Article 3 — Access to the Services
3.1 Access conditions
Access to the Application Services requires creating an account and expressly accepting these Terms.
The Services are reserved for natural persons of legal age with full legal capacity. Minors and persons lacking legal capacity may not access them.
3.2 Availability
The Application will be available for download on the App Store (Apple Inc.) and Google Play Store (Google LLC). The Website is accessible via a web browser.
The Publisher uses reasonable efforts to keep the Services available, without guaranteeing uninterrupted access (maintenance, force majeure, store or network failure).
Article 4 — User account
The User agrees to provide accurate and up-to-date information, to create only one account, and to keep login credentials confidential. Any activity carried out through the account is deemed performed by the User.
The Publisher may suspend or close an account in cases of fraud, multiple accounts, referral abuse, or breach of these Terms.
Article 5 — Description of the Services
KashDay notably allows Users to:
- answer a question (or quiz) according to the offered frequency;
- earn Kash under the rules shown in the Application;
- where applicable, watch ads or take part in partner actions, subject to consent when required;
- invite friends through a referral programme;
- convert Kash under Article 7.
On the Website, the User may join a waitlist to be notified of the launch.
Article 6 — Personal data
Data processing is described in the Privacy Policy. By using the Services, the User acknowledges having read it.
Some features (prospecting, personalised advertising, introduction to an advertiser) rely on separate consent, which may be withdrawn at any time.
Article 7 — Kash and conversion
Kash have no monetary value outside the Application: they are not transferable, assignable, or exchangeable between Users.
Unless otherwise stated in the Application: 1,000 Kash = €1. A minimum conversion threshold may apply (including from €5, i.e. 5,000 Kash, unless updated in-app).
Conversion may be made through the available methods (e.g. PayPal, gift cards), subject to identity checks and anti-fraud controls. The Publisher may refuse a request if abuse is suspected.
Crediting, bonus, referral and conversion rules may change; the version shown in the Application at the time of the relevant action applies.
Article 8 — User obligations
The User agrees in particular to:
- use the Services in good faith and for personal use only;
- not automate, defraud or circumvent earning mechanics;
- not infringe third-party or Publisher rights;
- comply with applicable laws and these Terms.
Article 9 — Publisher obligations
The Publisher agrees to provide the Services with due care, to process conversion requests under the published rules, and to implement reasonable security measures.
Article 10 — Liability
The Publisher shall not be liable for indirect damages, interruptions linked to stores, networks or third-party providers, or non-compliant use of the Services by the User.
To the extent permitted by law, the Publisher’s liability is limited to the amount of Kash converted by the User during the twelve months preceding the event giving rise to the claim.
Article 11 — Intellectual property
The Application, Website, trademarks, texts, visuals and software remain the exclusive property of the Publisher or its licensors. Any unauthorised reproduction is prohibited.
Article 12 — Suspension and termination
The User may request account closure at any time. The Publisher may suspend or terminate access in case of breach of these Terms, without prejudice to its other rights.
Unless otherwise provided, unconverted Kash may be cancelled upon account closure for User breach.
Article 13 — Changes to the Terms
The Publisher may amend these Terms. The update date appears at the top of the page. Material changes will be notified to the User (email, Website or Application).
Article 14 — Governing law & disputes
These Terms are governed by French law. Failing amicable resolution, disputes shall be brought before the competent French courts, subject to mandatory consumer protection rules.
